These Terms and Conditions govern the use of Patrick DuFrayne LLC websites and mobile applications (together the “Platforms”, or the “Site”). These Terms and Conditions govern your use of, and any purchase from, the Patrick DuFrayne LLC Platforms, and constitute an agreement between you and Patrick DuFrayne LLC

What information do we collect?
When you visit our Platforms you may provide us with two types of information: personal information you knowingly choose to disclose that is collected on an individual basis and website use information collected on an aggregate basis as you and others browse our website.

You provide us information about yourself when you register your Patrick DuFrayne LLC account on our website. This aids us in getting your jewelry to you faster. We will not mine, sell or give away your information.

Design and production images, renderings, sketches and videos
To allow people to follow along as we create your unique custom jewelry we may share our sketches, images, videos or renderings on publicly visible pages, Facebook, Instagram, or other sites as we design your piece.
You acknowledge and agree that any materials, including but not limited to questions, comments, suggestions, ideas, plans, notes, drawings, original or creative materials or other information, regarding this site, Patrick DuFrayne LLC, or our products or services that are provided to you by Patrick DuFrayne LLC are non-confidential and shall become the sole property of Patrick DuFrayne LLC. Patrick DuFrayne LLC will own exclusive rights, including all intellectual property rights, and will be entitled to the unrestricted use and dissemination of these materials for any purpose, commercial or otherwise, without acknowledgment or compensation to you. You grant Patrick DuFrayne LLC and its affiliates and sublicenses the right to use the name that you submit in connection with such content, if they choose. You represent and warrant that (a) you own and control all the rights to the content that you submit, or that you otherwise have the right to submit such content to this Site; (b) the content is accurate and not misleading; and (c) use and posting of the content you supply will not violate any rights of or cause any injury to any person or entity.

The Site and all content and other materials, including, without limitation, the Patrick DuFrayne LLC logo, and all designs, text, graphics, pictures, methods of operation, look and feel, data, software, other files and the selection and arrangement thereof (collectively, the “Patrick DuFrayne LLC Site Materials”) are property of Patrick DuFrayne LLC or its licensors or users and are protected by trade dress, copyright, patent and trademark laws, and other intellectual property rights and unfair competition laws.
General Site information
We make every attempt to ensure that our online info is as accurate and complete as possible. In order to give you the opportunity to view our products in great detail, some products may appear larger or smaller than their actual size in our photographs and renderings, and because of the differences in computers, browsers and monitors color and size may vary compared to the original product. As such Patrick DuFrayne LLC cannot be held liable for any apparent differences in the product images represented on our platforms and the original products. We want to provide you with as much information and detail about your prospective purchase as possible. In compliance with industry standards and FTC regulations, Patrick DuFrayne LLC states that carat total weight may vary slightly from stated weight.
On the Platforms, we provide the measurement of our products based on manufacturing specifications. Slight tolerances may be accounted for based on finishing during the manufacturing. For gemstone and pearl measurements, a tolerance of .25mm is allowed. For diamond jewelry set with multiple diamonds, we provide the minimum total carat weight for the piece. Color and clarity grades are expressed as either a minimum or an average depending on the number of diamonds.
You are not authorized to sell, reproduce, distribute, communicate, modify, display, publicly perform, report or otherwise prepare derivative or second-hand works based on or use Patrick DuFrayne LLC material in any way for public or commercial purposes. Furthermore, Patrick DuFrayne LLC material may not be displayed or communicated on any other platform, in a networked computer environment or on any other digital platform for any purpose whatsoever. In the event of the breach of any of these Terms and Conditions, your permission to use Patrick DuFrayne LLC material will automatically terminate and any copies made of Patrick DuFrayne LLC material must be immediately destroyed. Any unauthorized use of Patrick DuFrayne LLC material may infringe on copyright laws, trademark laws, the laws of privacy and publicity, and communications regulations and statutes.
